<p>Dear Mr. Titus, </p>
<p>I hope this letter finds you in good health. I am writing to provide further clarity and address some of the questions that arose during the Town of Lindley Planning Board meeting held last night regarding ESG Energy Holdings, LLC’s proposed project for the commercially zoned land adjacent to the Presho exit from Route 99. </p>
<p>First and foremost, I want to emphasize our commitment to the local community and our desire to collaborate closely with the Town of Lindley. The 27-acre parcel of land in question has been contributing to the local tax revenue for decades, with the current landowner paying approximately $4,000 per year. Over the past ten years, this has amounted to a significant $40,000 in tax revenue for the local taxing jurisdictions. </p>
<p>Our Proposed Project is a comprehensive initiative that includes a 3.0 Megawatt (MW) Solar Project, Digital Signage, and a 950 Square foot Electric Vehicle (EV) charging station. While this is our first EV charging station project, it is important to note that we have successfully executed similar solar and digital signage projects in the past. </p>
<p>Now, let’s delve into the substantial economic benefits that our project will bring to the community. The Project is designed to generate Real Property (RP) tax revenue from two primary sources. Firstly, there is the Payment In Lieu of Taxes (PILOT) for the Solar Project, which is directly tied to its rated size. At the current tax rate of $4,500 per MW per year, the Solar Project alone will contribute $13,500 annually, translating to an impressive $337,500 in RP tax income over 25 years. </p>
<p>The second source of RP tax revenue will come from the 950-square-foot charging station, estimated at approximately $5,000 per year, adding another $125,000 over the same 25-year period. When combined, the tax revenue generated by our proposed project will exceed $462,500, equating to $18,500 per year. In contrast, if the current landowner continues to pay taxes without the project, the RP tax income over the same timeframe would only amount to $100,000. Therefore, our plan offers a net additional tax income of $362,500 over the same period. </p>
<p>Moreover, I want to highlight an alternative scenario. If we decide not to proceed with the project at this site, there is a second offer from the Finger Lakes Land Conservancy. If they acquire the land, it will be donated to the State, similar to the recent transfer of 990 acres. In this case, the potential RP income for the Town, County, and Schools will be reduced to zero indefinitely. </p>
<p>In addition to these substantial tax benefits, ESG Energy Holdings, LLC is committed to supporting the Town of Lindley through a Community Benefit Donation of $6,000 per year. Over the project’s lifespan, this will amount to a generous total donation of $150,000, further demonstrating our dedication to the local community. </p>
<p>Lastly, I would like to address concerns raised during the meeting about end-of-life decommissioning. We are fully committed to responsible project management. Upon completion of construction, we typically provide a bond for the project’s removal to the Town, with the bond amount adjusted regularly to account for inflation and the Consumer Price Index (CPI) level. </p>
<p>Regarding the recycling of solar panels, please be assured that disinformation regarding the cost per panel was spread during the meeting. The actual cost for recycling each panel is significantly lower than the false figure of $3,000 each. We have a well-thought-out decommissioning plan that includes the accurate and reasonable cost per panel for recycling in Rochester, NY. The bond amount is based on our receiving one or more quotes from reputable contractors for the system removal. </p>
<p>In conclusion, I want to emphasize that the tax benefits of $18,500 per year for 25 years, coupled with our substantial community benefit donation and the employment opportunities for Town of Lindley residents, make this project a clear win-win for all parties involved. We are earnestly seeking your support and that of your esteemed board to move forward with this endeavor, which promises to bring lasting prosperity to our community. </p>
<p>Our plan for the project includes us completing our due diligence with all stakeholders, regulatory agencies and affected parties. Once we have compiled all of the data, we plan on returning to the Planning board with Project Specific data that will be needed for us to obtain the project’s building permits. </p>

<p>TAKE NOTICE, that I, Callie Perry, the undersigned Collector of Taxes of the Town of Lindley, County of Steuben, State of New York, have duly received the tax roll and warrant for the collection of taxes within the Town of Lindley for the year 2026, and that I will attend at Lindley Town Hall, 637 County Route 115, in the said Town of Lindley from January 1, 2026, to March 31, 2026, nine o’clock in the forenoon to twelve o’clock in the afternoon on Tuesday’s, Wednesday’s, Thursday’s and Saturday’s for the purpose of receiving the taxes listed on the said roll. </p>
<p>TAKE FURTHER NOTICE, that taxes may be paid on or before February, 2026, without charge or interest. On all taxes received after such date, there shall be added interest. One percent if paid on or before March 2, 2026, and an additional two percent for each additional month or fraction thereof thereafter until such taxes are paid or until the return of unpaid taxes to the County Treasurer pursuant to law. </p>

            <content:encoded><![CDATA[<p><strong>Steuben County</strong> Manager Jack Wheeler declared a local state of emergency Wednesday banning all outdoor burning due to the high potential for wildfires.</p>
<p>The state of emergency declares it illegal to conduct outdoor burning in Steuben County from 12 p.m. Wednesday until the executive order expires in five days at 11:59 a.m. on Monday, March 17, said Tim Marshall, Steuben County Director of Public Safety.</p>
<p><strong>New York State</strong> is set to initiate a burn ban next week.</p>
<p>The ban will officially go into effect statewide on March 16. Due to wildfires downstate, Governor Kathy Hochul <a href="https://www.governor.ny.gov/news/governor-hochul-details-state-response-long-island-brush-fires" title="https\://www.governor.ny.gov/news/governor-hochul-details-state-response-long-island-brush-fires" rel="nofollow" target="_blank">issued a burn ban</a> already for Long Island, New York City and parts of the Hudson Valley.</p>
<p><strong>During a burn ban, New York State residents are prohibited from burning the following:</strong></p>
<ul><li>Refuse, trash, tires and solid wastes</li>
<li>Loose leaves and leaf piles</li>
<li>Pressure of chemically treated wood, painted or stained wood, or composite wood such as plywood and particle board. Firewood that has been heat treated or kiln dried is allowed to be burned</li>
<li>The practice of burning large piles of brush collected from local residents at town or county transfer sites. The individual landowners in small towns may burn their brush on-site, as discussed above. Downed limbs and branches generated at a transfer site are also allowed to be burned on-site with the same restrictions.</li></ul>
<p><strong>The following types of open fires are allowed:</strong></p>
<ul><li>Campfires, small cooking fires or any other outdoor fire less than 3 feet high and 4 feet in length, width or diameter</li>
<li>Ceremonial or celebrity bonfires</li>
<li>For most of the year, downed tree limbs and branches (also called brush) that are less than 6 inches in diameter and 8 feet in length, including branches with attached leaves, are allowed to be burned on-site in towns with total population less than 20,000 residents. The burning of brush is prohibited from March 16 through May 14 due to the increased risk of wildfires.</li>
<li>Open fires to control the spread of invasive species are allowed with case-by-case approval from DEC. Approval can be obtained from DEC regional offices.</li></ul>

not more than five members appointed by the town board. The majority of the members cannot be
officers and employees of the town. The town assessor may not serve as a board of assessment
review member (Real Property Tax Law, Sections 102[3], [4], and 523).</p></li>

<p>PLEASE TAKE NOTICE that a proposed Local Law is under consideration by the Lindley Town Board, Town of Lindley, New York, designated as Local Law No. 2-2024 to Implement a Temporary Moratorium Relative to Solar Facilities and Battery Storage, but not including residential solar.</p>
<p>PLEASE TAKE FURTHER NOTICE that the purpose of said Local Law is to temporarily halt for a period of six months the development of new solar facilities in the Town (except for residential solar) while the Town of Lindley develops and adopts local legislation to regulate such solar facilities.</p>

            <content:encoded><![CDATA[<p><strong>Beginning in 2026,</strong> seniors no longer need to apply to their Assessor to qualify for Enhanced STAR. In addition, only ONE resident owner of the property - regardless of the relationship of the owners - must be at least 65 years of age as of December 31 of the benefit year. </p>
<p>This simple change may make it easier to receive Enhanced STAR. </p>
<p>New York State willl notify homeowners if they qualify for an Enhanced STAR exemption. A letter will be sent to Basic STAR exemption recipients who may be eligible for the Enhanced STAR exemption. A new webpage regarding the STAR changes will be launched soon through NYS and a printable handout will be provided to explain the changes. </p>
<p>Exemption recipients will not need to apply online. However, it is encouraged to keep your information up-to-date in the Homeowner Benefit Portal.</p>]]></content:encoded>

            <content:encoded><![CDATA[<p>The ceremony for Wreaths Across America will be held at the Presho Cemetery at 10a on Saturday, December 14, 2024, followed by the wreath laying. Our Volunteers will then travel to the Fairview Cemetery to lay wreaths, then onto the Lindsley Cemetery. </p>
<p>Earl Titus has graciously offered his bus service to transport volunteers to the Fairview and Lindsley Cemeteries from the Presho Cemetery. </p>
<p>Please park in the Presho Church of Jesus Christ parking area and walk to the Presho Cemetery. Once all wreaths are laid, we will return to the Presho Church parking area. </p>
<p>All are welcome to volunteer and be a part of the wreath laying. </p>
<p>Thanks to Tina Padgett, Rustic Pioneers 4H Club and Karen Ballard, Lindley Town Historian for putting this event together, and also, Earl Titus for providing transportation.</p>]]></content:encoded>
